This firm represents Pacific Mutual Insurance Company ("Pacific Mutual") in connection with the above-referenced claim. Pacific Mutual is in receipt of the complaint filed by Robert Thornton ("Claimant") in the matter of Thornton v. Pacific Mutual, Case No. 24-CV-08847 (Los Angeles Superior Court).
Pacific Mutual hereby agrees to provide a defense to the Insured under the above-referenced policy, subject to a full and complete reservation of all rights, defenses, and remedies available under the policy and applicable law, including but not limited to the right to deny coverage and/or seek reimbursement of defense costs.
POTENTIAL COVERAGE ISSUES
Pacific Mutual reserves its rights with respect to the following potential coverage issues:
1. Intentional Acts Exclusion. The policy excludes coverage for bodily injury or property damage expected or intended from the standpoint of the insured. [Policy § II, Exclusion 1(a)]
2. Business Pursuits Exclusion. The policy excludes coverage for bodily injury or property damage arising out of business pursuits of any insured. [Policy § II, Exclusion 2(b)]
